This successive bail petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is filed by the accused in S.C.No.2/2025 pending before the Court of the I Additional District and Sessions Judge, Mysuru, arising out of Crime No.169/2024 registered by the KTJ Nagar Police Station, Davanagere for offence punishable under Section 103(1) of Bharatiya Nyaya Sanhita, 2023. 2. Heard learned counsel appearing for the petitioner and learned HCGP appearing for the respondent-State. 3. The learned counsel for the petitioner submits that the petitioner, who has no criminal antecedents, is in custody in the present case from 21.09.2024 onwards. The trial in the case has commenced and, till date, only one witness has been examined as PW-1. He submits that CWs-12 to 15 are the alleged eyewitnesses to the incident in question. CWs-12 to 15 are all localites and, therefore, this petition may be disposed of with a direction to the Trial Court to examine the aforesaid witnesses within a - 3 - HC-KAR CNR: KAHC010343652026 NC: 2026:KHC:37341 CRL.P No. 7274 of 2026 time frame, reserving liberty to the petitioner to file a fresh bail application, in the event CWs-12 to 15 are not examined within the said time frame. 4. Learned HCGP does not seriously oppose the prayer made by the learned counsel for the petitioner. 5. Submissions made on both sides placed on record. 6. The criminal petition is disposed of with a request to the Trial Court to examine CWs-12 to 15 as expeditiously as possible, but not later than a period of six months from the date of receipt of a copy of this order, provided that the accused cooperates for the same before the Trial Court. In the event the aforesaid witnesses are not examined within the said time frame, liberty is reserved to the petitioner to file a fresh bail petition before the Trial Court.
