Advocate General Hon’ble Shri Amitendra Kishore Prasad, Judge Order on Board 30.07.2026 YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2026.07.30 18:36:37 +0530 2 1 By filing the present petition under Article 226 of the Constitution of India, the petitioner has prayed for following relief(s):- “10.1 That, this Hon'ble Court may kindly be pleased to direct respondent-authorities for payment compensation within stipulated time, in the interest of justice. 10.2 Any other relief/ order may also be granted that may be deemed fit and just in the facts and circumstances of the case.” 2 Learned counsel for the petitioner submits that during the pendency of the present writ petition, the respondent-State has revised the proposal for payment of compensation and, as per the revised proposal, the petitioner has become entitled to receive compensation to the tune of Rs.20,20,000/- in respect of the land utilized for construction/widening of the road. At this stage, learned counsel for the petitioner submits that he does not wish to press the present writ petition on merits. However, he prays that the respondent-authorities may be directed to disburse the aforesaid amount of compensation in favour of the petitioner within a reasonable period. 3 Learned State counsel submits that the revised proposal has already been forwarded to the competent authority for necessary approval and consequential disbursement of the compensation amount. He further submits that the process is underway and, subject to the petitioner's acceptance and cooperation in 3 completing the requisite formalities, the amount shall be disbursed. He, therefore, prays for 45 days' time to complete the said exercise. 4 I have heard learned counsel for the parties and perused the record. 5 Considering the limited prayer made on behalf of the petitioner and the fair stand taken by learned State counsel, without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to the respondent- authorities to disburse the compensation amount of Rs.20,20,000/- (Rupees Twenty Lakhs Twenty Thousand only) in favour of the petitioner within a period of 45 days from the date of receipt of a certified copy of this order, subject to the petitioner's acceptance of the revised proposal and cooperation in completing all necessary formalities. 6 With the aforesaid observations/directions, instant writ petition stands disposed of.
