Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that all the witnesses have been examined and only the Investigating Officer is left. Having considered that the prescribed punishment is for a fixed period of term, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Manik Biswas shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of 2 Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned CJM, Krishnagar, Nadia. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Nadia till further orders of the learned trial court. Additionally, the petitioner would meet with the Officer-in-charge/Inspector-in-charge of Bhimpur police station once in every ten days. In case there is any violation of any of the aforesaid conditions, the learned trial court would cancel the bail without further reference of this court. Accordingly, CRM (M) 1391 of 2026 is allowed.
