The present petition has been filed by the petitioner /husband for transfer of the divorce proceedings, bearing HMA No. 88 of 2020, titled as, Rajesh Kumar vs. Pooja Devi from the Court of learned Additional Principal Judge, Family Court, Sarkaghat, Camp at Jogindernagar to learned District Judge, Family Court, Mandi, District Mandi, H.P.

It is contended in the petition that the parties solemnized marriage on 19.04.2019 as per Hindu rites and customs. It is further contended that from the very inception of the marriage, confliction occurred between the parties and as a

result of which, the present respondent left the company of the petitioner. 3. After solemnization of the marriage, the petitioner was to relocate to Delhi on account of his employment. The respondent remained with her mother-in-law but her behaviour remains violent and quarrelsome, without any provocation. 4. Aggrieved by the behaviour of the respondent, the petitioner filed petition for dissolution of marriage under Section 13 (1) of the Hindu Marriage Act bearing HMA No. 88 of 2020 before the Court of learned District Judge, Principal Family Court, Mandi. However, in March, 2021, the said case was transferred to the Court of learned Additional Principal Judge, Family Court, Sarkaghat, Camp at Jogindernagar. 5. It is contended in the petition that the Court of learned Additional Principal Judge, Family Court, Sarkaghat, Camp at Jogindernagar operates as a circuit bench only once in every two months. It is the case of the petitioner that on account of irregular schedule of the said Court has resulted into inordinate delay in the present proceedings, which were initiated in the year 2020 and still have not reached the stage of framing of issues. 6. In order to expedite the case, the petitioner has approached this Court with a prayer that the proceedings

pending in the Court of Additional Principal Judge, Family Court, Sarkaghat, Camp at Jogindernagar be transferred to the Court of learned District Judge, Family Court, Mandi, District Mandi, H.P.
7. Notice was issued in the present case to the respondent on 16.12.2025. Today, learned counsel for the respondent, under instructions, has submitted that he has no objection in case the proceedings of HMA No. 88 of 2020 are transferred as per prayer made in the petition. 8.
Therefore, without adjudicating anything on merits of the case, the proceedings of HMA No. 88 of 2020, titled as Rajesh Kumar vs. Pooja Devi are transferred from the Court of learned Additional Principal Judge, Family Court, Sarkaghat, Camp at Jogindernagar to the Court of learned District Judge, Family Court, Mandi, District Mandi, H.P. The learned Additional Principal Judge, Family Court, Sarkaghat, Camp at Jogindernagar is directed to transfer the entire record of case No. HMA 88 of 2020 to the Court of learned District Judge, Family Court, Mandi, District Mandi, H.P. within a period of two weeks from today so that the Court of learned District Judge, Family Court, Mandi, District Mandi, H.P. can proceed further in the matter. -4-
9. The parties are directed to appear before the learned District Judge, Family Court, Mandi, District Mandi, H.P., on
11.05.2026. 10. Vide order dated 16.12.2025, the petitioner was
directed to deposit a sum of Rs. 10,000/- as litigation expenses to the respondent. The said amount is ordered to be released in favour of the respondent. Learned counsel for the respondent is directed to furnish the bank details of the respondent within two days and in the event of doing the needful, the Registry is
directed to remit the said amount in the bank account of the respondent immediately.

In view of above, the present petition is disposed of along with pending applications, if any.
