By this petition the petitioner seeks direction to the respondent No. 4 – The Collector, Ahilyanagar (State Excise Department) and respondent No. 5 – The Superintendent of Excise (Excise Department) Ahilyanagar to implement the order dated 24.05.2016 passed by the Hon’ble Minister of State Excise. 2. Learned Assistant Government Pleader for the respondents on instructions from the respondents has placed on record copy of the letters dated 04.07.2026, 04.03.2025 and the order dated 24.02.2025, by which the request of the petitioner for renewal of license is rejected. 3. Perusal of the order dated 24.02.2025 shows that no 2026:BHC-AUG:31565-DB 2 35 wp 8334.26 opportunity of hearing was given to the petitioner. 4. In that view of the matter, the said order is quashed and set aside and matter is remanded back to the respondent No. 3 – Deputy Commissioner of State Excise (Inspection), Mumbai for consideration afresh on merits. The respondent No. 3 shall consider the case of the petitioner after giving an opportunity of of hearing to the petitioner, on its own merits and within a period of eight (08) weeks from the date of first appearance of the petitioner.
