1. The petitioner has filed this petition seeking the following relief(s):-
“10.1 That, this Hon’ble Court may kindly be pleased to quash the impugned letter/order dated 11-07-2022 (Annexure P-1), issued by the office of respondent No. 2. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to give promotion to the petitioner to Digitally signed by RAMESH KUMAR VATTI Date: 2026.07.30 11:11:47 +0530
2 the post of Assistant Grade-II as per Chhattisgarh Secretoriat Services Recruitment Rules-2012 w.e.f. January-2022, as on that date he has completed five years of service according to the Rules-2012. 10.3 That, the Hon’ble Court may kindly be pleased to grant any other relief, as it may deem-fit and appropriate.”

Mr. Shikhar Sharma, learned counsel appearing for the petitioner would contend that the petitioner was appointed on the post of Assistant Grade-III under the respondents vide order dated 21.12.2016. He would contend that the petitioner became eligible for promotion to the post of Assistant Grade-II in the year 2022, but his name was not considered by the Departmental Promotion Committee, rather representation made by the petitioner was rejected vide order dated
11.07.2022. He would pray that the order Annexure P-1 may be quashed and direction may be issued to the respondent authorities to grant promotion with effect from January 2022.
3. On the other hand, Mr. Anil S. Pandey, learned Government Advocate appearing for the State/respondents would oppose. He would submit that the petitioner has already been promoted to the post of Assistant Grade-II vide order dated 31.01.2024. He would contend that the petition deserves to be dismissed.
4. Heard learned counsel for the parties.
5. Having considered the facts discussed above, as the petitioner has already been promoted to the post of Assistant Grade-II, the petitioner is granted liberty to make a detailed representation before the respondents No. 2 and 3 claiming therein seniority as well as benefits attached to the post with effect from January 2022 and in turn, the said
3 authorities are directed to decide representation so made by the petitioner expeditiously preferably within a period of 150 days.
6. With the aforesaid direction(s) / observation (s), this petition is
