22.07.2026 Court No.35.
D/L. 239. Kausik (Rejected)
CRM (M) 1396 of 2026
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Pingla Police Station Case No. 7 of 2016 dated 10.01.2016 under Sections 448, 326, 307, 364, 120B, 506, 302 & 201.
And In the matter of : Khokan Singh
……Petitioner.
Mr. Siddhartha Sarkar
Mr. Sourav Gupta
……for the Petitioner.
Mr. Goutam Dey
Mr. Neel Chakraborty
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for 155 days. He was earlier on bail but because of his absence warrant of arrest was issued and subsequently he surrendered and is in custody.
Learned advocate for the State opposes the prayer for bail.
I find that the case was under Section 302 of the Indian Penal Code along with Section 364 of the Indian Penal Code. Having regard to the nature of offence and petitioner misused the liberty granted to him, I am not inclined to release the petitioner on bail at this stage when the learned Trial Court is about to attain the finality of the proceedings.
