The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ, order or direction in the nature of certiorari for quashing impugned final seniority list of Divyang Clerks dated 20.06.2023 (Annexure P5) as well as the provisional seniority list dated 16.04.2025 (Annexure P7) and further quash the promotional order dated 10.07.2023 (Annexure P6) issued by respondent No.2 being violative of instructions/memo dated 01.05.2019(Annexure P2) as well as instructions dated 25.03.2022 (Annexure P3). Further directions to the respondents are sought to recast/reframe the seniority list of Divyang Clerks strictly in accordance with the applicable instructions as well as directions to the respondents to fill up the backlog vacancies of persons with benchmark disabilities. 2. On 10.04.2026, this Court passed the following order:- OMKAR SINGH 2026.07.15 09:48 I attest to the accuracy and integrity of this document High Court, Chandigarh 2 CWP-11138-2026 “It is inter alia contended that while giving promotion to the counterparts on the post of Assistant vide the impugned office order, dated 10.07.2023, Annexure P-6, clause 1 of the instructions dated 25.03.2022, Annexure P-3, has not been followed. The first fifteen promotions have been given only to the candidates belonging to locomotive disability, to the exclusion of other two categories of Visually Handicapped (VH) and Hearing Handicapped (HH). The similar pattern is apparent in promotions given from serial nos.23 to 32 also, which makes the order unsustainable. 2. Learned State counsel, appearing on advance notice, seeks an adjournment to get instructions. 3. Adjourned to 06.05.2026.” 3. On 06.05.2026 more time was sought by learned State counsel to comply with the order. Same is the position today. 4. At this stage, learned counsel for the petitioners has limited his prayer to the extent that the present petition be treated as a comprehensive representation and the same be ordered to be decided in a time bound manner by passing a speaking order after affording an opportunity of being heard. 5. Learned State counsel submits that he has no objection in case a direction is issued to respondent No.4/competent authority to consider and decide the claim of the petitioners by passing a reasoned and speaking order in accordance with law. 6. In view of the limited prayer made by learned counsel for the petitioners and without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to respondent No.4/competent authority to treat the present writ petition as a comprehensive OMKAR SINGH 2026.07.15 09:48 I attest to the accuracy and integrity of this document High Court, Chandigarh 3 CWP-11138-2026 representation and to consider and decide the claim of the petitioners by passing a reasoned and speaking order, in accordance with law, within a period of three months from the date of receipt of a certified copy of this order. 7.
