1. Heard.
2. The petitioner has filed this petition seeking following relief(s) :
“10.1 That, this Hon'ble Court may kindly be pleased to call the entire records concerning the case of the petitioner relating to denial of employment on the basis compassionate appointment. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authority to give employment to the petitioner under compassionate appointment in place of his father, in the larger interest of justice. 10.3 Any other relief (s) that this Hon'ble Court may deem fit to grant in the facts and circumstances of this case.
3. The facts, in brief, are that the father of the petitioner, namely, Late Somaru, was working on the post of Conveyer Operator under
-2- the respondent authorities. He died in harness on 22.04.2005. The petitioner, who is the son of the deceased employee, moved an application for compassionate appointment before the respondent authorities on 07.09.2011. The petitioner has sought a direction to the respondent authorities to consider the application moved by him for compassionate appointment in accordance with the prevailing Rules.
4. Ms. Nikita Dubey, learned counsel appearing for the respondent authorities would contend that the petitioner approached the respondent authorities after six years without explaining the delay. She would fairly submit that if the application moved by the petitioner has not yet been considered and decided, an appropriate decision will be taken by the respondent authorities.
5. I have heard Ms. Dubey, learned counsel for the respondent authorities, and perused the documents placed on record.
6. Having considered the facts of the present case and the prayer sought by the petitioner in the instant petition, this petition is
disposed of with a direction to the respondent authorities to consider and decide the pending application of the petitioner for grant of compassionate appointment dated 07.09.2011 strictly in accordance with the existing Rules, preferably within a period of 150 days from the date of receipt of a copy of this order.
7. With the aforesaid observation(s)/direction(s), the present petition is disposed of. Sd/-
