The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘the BNSS, 2023’) for grant of regular bail to the petitioner who is in custody in connection with Andharamath P.S. Case No. 151 of 2025, lodged on 29.08.2025, under Sections 126(2), 115(2), 118(1), 117(2), 109, 352, 351(2), 351(3) and 61(2) of the BNS, 2023 and under Section 27 of the Arms Act. 3. As per the prosecution, FIR has been lodged against five named and one unknown accused persons including the present petitioner. It has been alleged by the informant that her husband had been shot in the back and he was in pain. It has Patna High Court CR. MISC. No.41319 of 2026(3) dt.07-08-2026 2/3 also been alleged that the villager Jiwachch Yadav was running away from there with pistol in his hand and along with him other named accused persons including the present petitioner was there. Allegation against one boy armed with weapon is also there. 4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that there is one criminal antecedent of the petitioner and he is on bail. He further submits that in the FIR, there is no allegation of act or overact against the petitioner rather he is said to be the member of the mob. He further submits that the petitioner is in custody since 08.02.2026. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him. 5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that allegation is there in the FIR against all the accused persons and gun shot injuries have been received by the husband of the informant. 6. Considering the facts that there is no allegation of act and overact against the petitioner and he is in custody since 08.02.2026, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Patna High Court CR. MISC. No.41319 of 2026(3) dt.07-08-2026 3/3 Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned S.D.J.M, Jhanjharpur, District- Madhubani in connection with Andharamath P.S.
