The petitioners have sought a direction to the Collector and Assistant Commissioner of the respective Districts to appoint them as contingency fund employees and grant them the appropriate pay-scale as sanctioned by the State Government. 2. The facts, in brief, are that the petitioners were appointed against sanctioned and vacant post of Peon on Collector Rate in the year 2008. A decision was taken by the State Government to appoint all Class-IV employees (Peon), who have completed three years of service on Collector Rate under the contingency fund and to grant them pay-scale of Rs.4750-7440 with Grade Pay of Rs.1,300/-. 3. Learned counsel for the petitioners would contend that the services of petitioners No.1 to 4 in WPS No.1324 of 2018 have been considered by the respondent authorities whereas, rest of the petitioners are still awaiting a favourable order. He would submit that a direction may be issued to the respondent authorities to consider the services of the petitioners in accordance with the circulars dated 12.12.2014 & 4.11.2016 within a stipulated time. 4. Learned counsel appearing for the State would oppose the submissions made by counsel for the petitioners. He would submit that the posts are not available, therefore, the services of all the petitioners have not been considered. He would contend that as and 6 when posts became available in the department, an appropriate decision would be taken. 5. Heard. 6. Having considered the submissions advanced by the respective advocates, the petitioners, whose services have not been regularized according to circulars dated 12.12.2014 & 4.11.2016, are granted liberty to make representations before respondents No.3 & 4 within a period of 30 days and in turn, the concerned authorities are directed to consider the claims of the petitioners in light of the circulars dated 12.12.2014 & 4.11.2016 expeditiously, preferably within a period of further 120 days. 7.
