THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE D K SINGH and HON'BLE MR. JUSTICE T.M.NADAF ORAL ORDER (PER: HON'BLE MR. JUSTICE D K SINGH) Learned counsel for the respondents-Karnataka Telecom Department Employees Cooperative Society Limited (for short 'the Society') submit that the Society had already undertaken before the Karnataka State Consumer Dispute Redressal - 3 - HC-KAR NC: 2026:KHC:35611-DB WP No. 1818 of 2025 Commission, Bengaluru, that it would execute the sale deed for the site measuring 40 x 60 sq.ft. in favour of the petitioner and it stands by said undertaking even today. 2. He however, submits that an amount of Rs.2,88,000/- needs to be paid by the petitioner and that if the said amount of Rs.2,88,000/- is paid, the Society will execute sale deed in favour of the petitioner in respect of a clear, vacant, undisputed and unencumbered site within a period of 10 days. However, the registration charges are to be borne by the petitioner. 3. Learned counsel for the petitioner submits that the petitioner will hand over the demand draft for a sum of Rs.2,88,000/- to the Society within a period of 15 days from today. 4. Considering the aforesaid submission, we dispose of this writ petition with a direction to the petitioner to make payment by way of a demand draft for a sum of Rs.2,88,000/- in favour of the respondent/Society within a period of 15 days from today i.e., on or before 01.08.2026 and the Society will execute the sale deed in the layout of the Society, in respect of a site - 4 - HC-KAR NC: 2026:KHC:35611-DB WP No. 1818 of 2025 measuring 40 x 60 sq.ft. as stated above on or before 17.08.2026. 5. Any deviation by the Society would result in serious consequences including the drawing up of a contempt proceedings and revival of the non-bailable warrant issued against the respondent/Society.
