Learned advocate appearing for the petitioner submits that although the total recovery in the present case is 11.44 grams of brown sugar but the recovery from the present petitioner is restricted to 339 grams of brown sugar. The petitioner is in custody for more than seven months. The trial would consume substantial amount of time. As such, the petitioner be released on bail. Learned advocate for the State opposes the prayer for bail. In view of the quantum of brown sugar recovered. Having regard to Section 37 of the NDPS Act, I am not inclined to release the petitioner on bail. The learned Trial Court would put in efforts so that the seizure list witness examined after the charges are framed at the earliest. At this stage, the prayer for bail of the petitioner is rejected. 2 Accordingly, CRM (NDPS) 1492 of 2026 is rejected.
