22.07.2026 Court No.35.
D/L. 698. Kausik (Allowed)
CRM (A) 1879 of 2026
In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Manikchak Police Station Case No. 817 of 2025 dated 30.10.2025 under sections 103(1)/3(5) of BNS, 2023.
And In the matter of : Amit Lohar & Ors.
……Petitioners.
Mr. Apan Saha
Mr. Musharaf Alam Sk
Mr. Tasnim Ahamed
……for the Petitioners.
Dr. Pradip Banerjee, APP Mr. Sankalpa Bhattacharjee
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is similarly placed as the other accused persons who have been granted anticipatory bail in CRM (A) 1413 of
2026.
Learned advocate for the State opposes the prayer for anticipatory bail but is unable to refute the locus of the present petitioners.
Having considered the same, I am inclined to extend the same benefit to the present petitioners. Petitioners are allowed anticipatory bail on same terms and conditions as was imposed
2 to the other accused persons namely, Feku Chowdhury & Ors. in CRM (A) 1413 of 2026.
Thus prayer for anticipatory bail in CRM (A) 1879 of 2026 is allowed.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
