Learned counsel for the petitioner submits that the petitioner has assailed the order dated 26.04.2025 passed by the Senior Superintendent of Police, Durg, whereby he has been dismissed from service by invoking the provisions of Article 311(2)(b) of the Constitution of India without holding any departmental inquiry. It is JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2026.07.30 11:22:16 +0530 2 submitted that the impugned order does not disclose any valid or legally sustainable reason for dispensing with the departmental inquiry. It is further submitted that the petitioner has been acquitted by the learned Special Judge (NDPS Act), Durg vide judgment dated 26.02.2026, thereby rendering the very basis of the dismissal unsustainable. Learned counsel further submits that though the appeal preferred before the Inspector General of Police came to be rejected, the statutory appeal dated 15.04.2026 (Annexure P-5) preferred before the Director General of Police, Police Headquarters, Naya Raipur is still pending consideration. He, therefore, confines his prayer to a direction for expeditious disposal of the said appeal. 2. Learned State counsel submits that if the petitioner's statutory appeal dated 15.04.2026 is pending before the Director General of Police, Police Headquarters, Naya Raipur, the same shall be considered and decided within a stipulated period in accordance with law. 3. I have heard learned counsel for the parties and perused the documents. 4. Having heard learned counsel for the parties and considering the limited prayer made by learned counsel for the petitioner, this Court, without expressing any opinion on the merits of the case, deems it appropriate to dispose of the present writ petition with a direction to the Director General of Police, Police Headquarters, Naya Raipur, to consider and decide the petitioner's statutory 3 appeal dated 15.04.2026 (Annexure P-5), if the same is still pending, by passing a reasoned and speaking order in accordance with law, preferably within a period of 30 days from the date of receipt of a certified copy of this order. 5. It is made clear that this Court has not expressed any opinion on the merits of the controversy and the appellate authority shall decide the appeal independently, strictly in accordance with law. 6.
