THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER The petitioner has called in question the Endorsements dated 15.06.2018 and 21.07.2018 issued by respondent No.4, produced as Annexures-P2 and P3, respectively. The petitioner has, inter alia, sought for a direction to the respondents to consider the representation dated 21.09.2016 and 11.04.2017 produced as Annexure-P and P1. - 3 - HC-KAR NC: 2026:KHC:35626 WP No. 53840 of 2018 2. Heard the learned counsel appearing for the parties. 3. Upon careful consideration of the submissions made and the material placed on record, it is evident from the impugned endorsements that a joint inspection of the land in question was conducted. However, a perusal of the records indicates that no prior notice was issued to the petitioner before conducting the said inspection. Therefore, this Court is of the considered opinion that the impugned Endorsements at Annexures-P2 and P3 are liable to be set aside on the ground of violation of the principles of natural justice. 4. Accordingly, it is open to respondent No. 4 to conduct a fresh spot inspection and joint survey of the land in question along with the jurisdictional Assistant Director of Land Records (ADLR), after - 4 - HC-KAR NC: 2026:KHC:35626 WP No. 53840 of 2018 issuing prior notice to the petitioner and all other interested persons. Thereafter, respondent No. 4 shall consider the petitioner's representation produced as Annexure- and pass appropriate orders in accordance with law. Accordingly, the following: ORDER (i) The writ petition is allowed. (ii) The Endorsements dated 15.02.2018 and 21.07.2018 issued by respondent No. 4, produced as Annexures-P2 and P3, are hereby quashed. (iii) It is open for the petitioner herein make necessary application as stated in the representation at Annexure- P1, which has been made during the year 2017. - 5 - HC-KAR NC: 2026:KHC:35626 WP No. 53840 of 2018 (iv). In that view of the matter, revenue authorities directed to enter the name of the petitioner in respect of the subject land in terms of the registered Sale Deed dated 07.06.2007 (Annexure-F).
