The petitioner has preferred this application for grant of regular bail in connection with Dalsinghsarai P.S. Case No. 51 of 2026 registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109(1), 103(1) and 76 of the B.N.S.

As per the allegation, the petitioner, along with the other co-accused persons, with a common intention, entered the house of the informant’s maternal uncle in connection with a dispute arising out of a fight between the children of the respective family members and started misbehaving with the female members, in course of which, co-accused Md. Kalam with an intention to kill, assaulted the mother of the informant

Thereafter, it is alleged that this petitioner with an intention to kill, assaulted the maternal aunt of the informant namely, Mina Khatun by means of lathi on her head while, co-accused Md. Sahil and Md. Sajid assaulted the maternal grandmother and sister-in-law of the informant. The injured persons were taken to hospital for better treatment, injured mother of the informant namely Tarannum Begum was referred to D.M.C.H., Darbhanga and during course of treatment, she succumbed to her injuries. 4. Learned counsel for the petitioner has submitted that the occurrence took place suddenly, without any premeditation or intention to kill, and arose out of a trivial issue. It is further submitted that the specific allegation of assault upon the deceased mother of the informant, namely, Tarannum Begum, is attributed to co-accused Md. Kalam, whereas the allegation against the petitioner is confined to the assault upon the maternal aunt of the informant, namely, Mina Khatun.
It has further been submitted referring to the impugned order, that the said injured, Mina Khatun, sustained only simple injuries, and a statement to this effect, has been made in paragraph no. 11 of the present bail application. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner. 6. Heard learned counsel for the parties and perused the records. 7. Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Dalsinghsarai, Samastipur, in connection with Dalsinghsarai P.S.
