Prasad Government Advocate for R1 to R3 __________ Page1 of 5 https://www.mhc.tn.gov.in/judis WP No. 18009 of 2026 ORDER This writ petition has been filed for issuance of writ of mandamus seeking a direction to the 3rd respondent to sanction pension, arrears of pension, family pension and arrears of family pension to the petitioner, being the widow of her late husband. 2. The case of the petitioner is that the petitioner is the widow of late Mr.Esakiyappan, an Ex-serviceman, who was permanently absorbed as an Inspector of Police in the Bomb Detection and Disposal Squad pursuant to G.O.Ms.No.522 dated 24.06.2005. He had rendered about 14 years of unblemished and meritorious service, earned several accolades, and attained superannuation in January 2010. 3.The grievance of the petitioner is that despite his long and satisfactory service, neither pension nor other retiral benefits were sanctioned to him during the lifetime. Even after his demise on 07.05.2013, the petitioner was not granted family pension. Repeated representations submitted by the petitioner seeking pensionary benefits allegedly remained unattended. One Mr.K.Alagarsamy, who was similarly appointed in the same cadre was granted pension and __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP No. 18009 of 2026 consequential family pension benefits despite having rendered a shorter period of service. The denial of similar benefits to the petitioner’s husband is stated to be discriminatory and violative of the principle of equality. Hence, the present petition has been filed. 4. Heard the learned counsel appearing on either side and perused the materials available on record. 5. Though the petitioner has sought a larger relief, this Court, without expressing any opinion on the merits of the claim, directs the second respondent to consider the petitioner’s representation dated 07.04.2026 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 6. With the above directions, this writ petition is disposed of. No costs.
