Rakib (Allowed) CRM (M) 1418 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bongaon Police Station case no. 412 of 2025 dated 19.04.2025 under Sections 14A(b)/14c of the Foreigners Act, 1946. And In the matter of : Sumi Molla @ Summi Molla & Ors. ……Petitioners. Mr. Niladri Sekhar Ghosh Ms. Labani Sikder Mr. Souvik Dey Mr. Subrajyoti Hazra .....for the Petitioners. Mr. Koustav Lal Mukherjee ……for the State. Learned advocate appearing for the petitioners submit that the petitioners are in custody for one year two months and there is no possibility of the trial being taking to its logical conclusion and the sentences prescribed are for fixed terms. Learned advocate appearing for the State opposes the prayer for bail as the petitioners were apprehended at a range of 3 km from the border. Having considered that there is no possibility of the trial concluding, I am inclined to release the petitioners on bail. Accordingly, the prayer for bail of the petitioners is allowed. As such, the petitioners, namely, Sumi Molla @ Summi Molla, Sabina Mulla and Beflab Mulla shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand 2 only) each with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Bongaon, North 24 Parganas. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of North 24 Parganas without prior permission of the learned Court. Thus, CRM (M) 1418 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
