JUSTICE RANJAN KUMAR JHA ORAL ORDER 3 07-08-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Manpur P.S. Case No. 193 of 2025, registered for the offences punishable under Sections 80, 167, 61(2), and 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023, along with Sections 3 and 4 of the Dowry Prohibition Act. 3. The allegation is that the sister of the informant got married in 2025 to Manish Kumar and she was tortured for dowry by her husband, father-in-law, and others. The F.I.R. further contains that the last conversation between the informant and his sister took place on 02.12.2025, and thereafter when no Patna High Court CR. MISC. No.40719 of 2026(3) dt.07-08-2026 2/3 contact could be made, he got suspicious and on 05.12.2025 came to the matrimonial house of his sister where he found the gate locked. Thereafter, becoming suspicious, he lodged the F.I.R. raising suspicion against the husband, his father, Swarath Yadav, the wife of Swarath Yadav, and further suspicion was raised against the maternal uncle of the husband. 4. Counsel for the petitioner submits that the petitioner is Sudhir Kumar, maternal uncle of the husband, having no role in the day-to-day family affairs of the sister of the informant. Further submission of counsel for the petitioner is that even during investigation, there is no material to fasten criminal liability upon him. There is no specific role of the petitioner that surfaced during investigation, except the general allegation that he along with others tried to hide the dead body. Referring to paragraph 24 of the petition, it is submitted that the husband is already in custody. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail. 6. Having considered the submissions of the parties, in particular that the petitioner is the maternal uncle (mama) of the husband, the general nature of allegations, and that the husband is already in custody, let the petitioner, above named, in Patna High Court CR. MISC. No.40719 of 2026(3) dt.07-08-2026 3/3 the event of arrest or surrender before the court below within a period of four weeks from today be released on anticipatory bail on furnishing a bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- II, Nalanda at Biharsharif, in connection with Manpur P.S. Case No. 193 of 2025, subject to the conditions laid down under Section 482(2) of the BNSS as well as the following conditions: (i) One of the bailors shall be a close family member of the petitioner. (ii) Non-cooperation during investigation/trial or involvement in a similar offence in future shall be a ground for the prosecution to move for cancellation of the bail bond furnished in connection with the case in the court below. rashmi/- (Ranjan Kumar Jha, J) U T
