Kausik (Allowed) CRM (A) 1856 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ghola Police Station Case No. 64 of 2026 dated 06.03.2026 under sections 85/80/3(5) of the BNS, 2023. And In the matter of : Basudeb Shil & Anr. ……Petitioners. Mr. Debasis Kar Ms. Sahana Parvin ……for the Petitioners. Mr. Pinaki Bhattacharyya, Sr. Govt. Adv. Mr. Amartya Mohan Bhattacharyya ……for the State. Learned advocate appearing for the petitioner submits petitioner no. 1 is the father-in-law and petitioner no. 2 is the brother-in-law of the deceased. Both of whom have been implicated in the present case. According to the petitioner marriage was solemnized in the year 2021 and the victim died by committing suicide. Learned advocate for the State opposes the prayer for bail and submits that there are statement under Section 183 of the BNSS, attention of the Court has also been drawn to the post-mortem report. 2 I have taken into account the overall circumstances appearing in the case diary and also the fact that charge sheet has been submitted before the jurisdictional Court. Having considered the same, I am of the view that custodial detention of the petitioner may not be warranted. As such, prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted this order of anticipatory bail will remain in force for a period of 6 weeks. Accordingly, CRM (A) 1856 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
