JUSTICE E.S.INDIRESH ORAL ORDER Heard the learned counsel appearing for the parties. 2. In this Writ Petition, the petitioner has sought for a direction to the respondent No.3 to implement the direction issued by the respondent No.2 as per - 3 - HC-KAR NC: 2026:KHC:18650 WP No. 5626 of 2026 Communication dated 03.04.2025. (Annexure-C) and Communication dated 19.11.2025 (Annexure-L). 3. Having taken note of the submissions made by the learned counsel appearing for the parties, the relevant facts are that, the petitioner was working as a Secretary of Respondent No.3-Society. The Special Officer by order dated 16.12.2024 (Annexure-A) suspended the petitioner as the Secretary of the respondent No.3-Society. It is also to be noted that the respondent No.2 vide Communication dated 03.04.2025 (Annexure-C) directed the respondent No.3-Society to reinstate the petitioner as a Secretary to the respondent No.3-Society subject to compliance of the terms and conditions specified therein in the Communication dated 03.04.2025 (Annexure-C). 4. As the petitioner herein has been suspended as per Annexure-A for misappropriation of a sum of Rs.8,05,479/- (Rupees Eight Lakhs Five Thousand Four Hundred and Seventy Nine only), and no enquiry has been ordered or held by the respondent No.2, I am of the view - 4 - HC-KAR NC: 2026:KHC:18650 WP No. 5626 of 2026 to direct respondent No.3-Society to comply with the direction issued by the respondent No.2 in their Communication dated 03.04.2025 (Annexure-C) and the Communication dated 19.11.2025 (Annexure-L) subject to the conditions stipulated in the Communication dated 03.04.2025 (Annexure-C). 5. In that view of the matter, the respondent No.3-Society shall implement the Communication dated 03.04.2025 (Annexure-C) and the Communication dated 19.11.2025 (Annexure-L) within two(2) months from the date of receipt of this order subject to the conditions specified thereunder. 6.
