Present is an application under Section 419(4) of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of leave to file acquittal appeal. 2. It transpires from the order sheet that on 14.11.2024, Mr. B.L. Sahu, learned counsel appearing for the petitioner submitted that the default has been removed and it was directed the Registry to verify MANISH YADAV Digitally signed by MANISH YADAV Date: 2026.02.06 12:27:27 +0530 2 and to proceed further. However, on 15.12.2025, no one appears on behalf of the petitioner in two rounds and the case was adjourned. Again on 07.01.2026, when the matter was called for hearing, no one appears on behalf of the petitioner to pursue the petition and again the matter was listed on defaults. Though no one appears on behalf of the petitioner, but two weeks time was granted to the petitioner to remove the default, yet till date the default could not be removed by the petitioner and no one appears on his behalf and no representation is made and today also the matter has been listed for orders on default. 3.
