1. This writ petition assails a final order of assessment dated May 05, 2025 passed by the Assessing Officer under Section 126 of the Electricity Act, 2003.
2. A final order of assessment is assailable before the Appellate Authority under Section 127 of the Act within a period of 30 days.
3. This writ petition therefore cannot be entertained.
4. Mr. Halder, learned Advocate appearing for the petitioner submits that a direction may be passed for restoration of supply upon payment of 50% of the assessed sum so that the petitioner may attempt to pay the balance sum in installments.
5. No mandatory order to such effect can be passed. However, the petitioner is left free to make appropriate representation before the respondent CESC Authorities. The CESC authorities shall be free
2 to consider the same and to grant appropriate installments to the petitioner if they deem it fit. However, it is clarified that this order will not be treated as mandate to grant any installment and restore supply upon payment of 50% of the assessed sum.
6. The respondent CESC Authorities shall dispose of the petitioner’s representation within a period of four weeks from the date of making of such representation.
7. WPA 14787 of 2026 stands disposed of with the above observations. There shall be no order as to costs.
8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
