Bajaj … for the petitioner(s) Mr. Koustav Lal Mukherjee … for the State-respondent(s) Learned advocate for the petitioners submits that although the case has been registered in the year 2026 but the factual circumstances of the case refers to the incident of 2021. Learned advocate for the State opposes the prayer for anticipatory bail. Having considered the factual circumstances of the case, after five years of the incident, I am of the view that custodial detention of the present petitioners may not be warranted, as such, I am inclined to grant the prayer for anticipatory bail of the present petitioners. 2 Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Pankaj Kumar Singh and Haradhan Chowdhury] be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. If on anticipatory bail, the petitioners shall meet with the investigating agency and make themselves available as and when called for till the charge-sheet is submitted. Additionally, since a Notice under Section 41A Cr.P.C. was issued, the petitioner no.2 shall meet with the Investigating Officer of the case on or about 6th August, 2026. Accordingly, CRM (A) 1761 of 2026 is disposed of. Memo of Evidence submitted be kept with the record.
