Learned advocate appearing for the petitioner submits that petitioner is a lady who has been implicated in the instant case. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the injury report. I have taken into account the records of the case which reflects that Istar Ali Sekh, the husband of the present petitioner has been granted anticipatory bail by the learned Sessions Judge, Nadia. Having considered that the statement do reflect the present petitioner and Istar Ali Sekh being on the same footing, I am inclined to extend the same relief to the present petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is allowed. 2 As such, I direct that in the event of arrest, the petitioner shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, the investigation is in progress, petitioner shall make herself available as and when required by the investigation officer of the case. Accordingly, CRM (A) 1923 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
