Learned advocate appearing for the petitioner submits that petitioner is innocent and has been implicated as there were certain recoveries of Codeine Phosphate from his house. Petitioner’s wife was arrested and subsequently released on bail. Learned advocate for the State opposes the prayer for bail and produces the case diary. Having considered the merits of the case, I am of the view that a case has been made out. As such, this is not a fit case for anticipatory bail. Petitioner be better advised to appear and pray for regular bail before the jurisdictional Special Court. Accordingly, CRM (A) 1860 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
