JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in Crime No.178/2026, pending before the V ACJM at Bengaluru, for the offences under Sections 351(2), 115(2), 118(1), 352 of BNS, 2023. 2. Heard Smt.Divyashree V, learned counsel appearing for the petitioner, Smt.Deepthi Alva, learned HCGP appearing for respondent No.1, Sri.Manikantha J, learned counsel - 3 - HC-KAR CNR: KAHC010468312026 NC: 2026:KHC:36247 CRL.P No. 10069 of 2026 appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application/compromise petition along with the verifying affidavits. The said compounding application/compromise petition reads as follows: “PETITION FILED UNDER SECTION 359 OF THE BHARATIYA NAGARIKA SURAKSHA SANHITA, 2023 R/W SECTION 528 OF BNSS. 1. The Petition is filed by the Petitioner for quashing the criminal case registered against petitioner by the Respondent No.2 in Cr.No. 178/2026 of Cottonpet P.S. 2. The FIR has been registered against the Petitioner/accused under Section 351 (2), 115 (2), 118 (1), 352 of BNS, 2023. 3. It is respectfully submitted that during the pendency of the present proceedings, Petitioner and Respondent No.2/Complainant have amicably resolved their differences. The settlement was arrived at with the intervention of friends and well-wishers, and pursuant thereto, the parties have settled their dispute amicably. 4. It is further submitted that the Respondent No. 2 has no objection for quashing the criminal proceedings against Petitioner/Accused in the interest of justice. 5. It is submitted that the parties have amicably settled their dispute. The parties further undertake that they shall not initiate or institute any complaint, case or legal - 4 - HC-KAR CNR: KAHC010468312026 NC: 2026:KHC:36247 CRL.P No. 10069 of 2026 proceedings against each other in respect of the present dispute or any matter arising out of the same in future, and both parties agree to maintain peace and cordiality. 6. The parties submit that the compromise has been arrived at voluntarily and without any force, coercion or undue influence. 7. The continuation of the criminal proceedings would serve no useful purpose in view of the settlement arrived at between the parties. Wherefore, it is prayed that in view of the compromise between the parties, this Hon'ble Court may kindly allow this petition in the interest of justice.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of compounding application/compromise petition as quoted supra along with the verifying affidavits being filed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. - 5 - HC-KAR CNR: KAHC010468312026 NC: 2026:KHC:36247 CRL.P No. 10069 of 2026 [II] Proceedings in Crime No.178/2026, pending before the V ACJM at Bengaluru, stands quashed qua the petitioner.
