In course of hearing, Ms. Sinha, learned advocate appearing for the West Bengal Pollution Control Board, produces an order passed by the Assistant Environmental Engineer, P.G. Cell, West Bengal Pollution Control Board, and submits that an order has been passed directing the private respondents not to carry on any poultry farming activity at the present location. She further submits that the Officer-in-Charge of the jurisdictional police station has also been directed to ensure that the private respondents do not carry on any such poultry farming activity at the said location. Let the said order, as produced on behalf of the West Bengal Pollution Control Board, be retained with the record. Copies thereof have been handed over to the private respondents and the petitioner.
2 Therefore, in view of the fact that the West Bengal Pollution Control Board has already taken appropriate steps in the matter, we are not inclined to interfere in the present writ petition. Accordingly, the writ petition stands disposed of. Needless to observe, the private respondent nos. 11 and 12 shall be at liberty to challenge the said order before the appropriate forum, if so advised and in accordance with law.
