Das ..for the petitioner Mr. Sandeep Prasad Shaw ..for the State The petitioner has approached this Court seeking the expeditious disposal of G.R. Case No. 4689 of 2024 arising out of Bizpur Police Station Case No. 151 of 2024 dated July 10, 2024, which culminated in Charge Sheet No. 115 of 2025 dated August 14, 2025, under Section 381 of the Indian Penal Code, 1860, and is presently pending before the Court of the learned Additional Chief Judicial Magistrate, Barrackpore, North 24 Parganas. Learned counsel appearing for the petitioner submits that cognizance of the offence was taken by the learned Additional Chief Judicial Magistrate, Barrackpore, on August 14, 2025. However, despite the lapse of considerable time, no further progress has been made in the proceedings. It appears from the records that the prosecution proposes to examine six witnesses. I find no justification for keeping the present application pending. Accordingly, the learned Additional Chief Judicial Magistrate, Barrackpore, is directed either to conduct the trial himself or to transfer the case forthwith to any other competent Magistrate within his jurisdiction for its expeditious disposal. The Trial Court shall make every endeavour to conclude the trial as expeditiously as possible, preferably within a period of two years from the date of communication of this order, without granting any unnecessary adjournments to either of the parties. The aforesaid direction is issued in exercise of the powers conferred under Section 483 of the Criminal Procedure Code, 1973. Accordingly, CRR 260 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.) 2
