Das … for the defacto-complainant(s) Learned advocate for the petitioner submits that the petitioner is in custody for 135 days; charge-sheet has already been submitted and there is no incriminating material to suggest further detention of the present petitioner as he was not named in the FIR. Learned advocate for the defacto-complainant is present and opposes the prayer for bail. Learned advocate for the State produces the case diary and draws the attention of the court to the statement of the witness who has last seen the present petitioner along with the deceased. Learned advocate added that there was recovery of the offending weapon pursuant to the leading statement of the petitioner as also the post mortem report. 2 Having considered the overall circumstances, at this stage, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1390 of 2026 is dismissed. Memo of Evidence submitted be kept with the record.
