Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the memo dated 27.06.2017 (Annexure P-9) to the extent that petitioner’s post of Junior Librarian has wrongly been placed in Level-4 instead of Level-6 while implementing 7th Pay Commission. Further a writ of mandamus has been sought, directing the respondents to refix the pay of the petitioner in Level-6 corresponding to GP Rs.3600/- w.e.f. 01.01.2016 with all consequential service and retiral benefits including arrears with interest @ 9% per annum on delayed payment till the date of realization. 2. Mr. Tilak Raj, Advocate for Mr. Rajesh Gaur, Advocate has put in appearance on behalf of respondent No.4 and filed Power of Attorney, which is taken on record. The Registry is directed to tag the same at appropriate place. 4. Learned State counsel as well as learned counsel for respondent No.4, appearing on advance notice, submits that they have no objection, in case a direction is issued to respondents No.2 and 3/competent authority for time-bound consideration and decision of the representation (Annexure P-16) submitted by the petitioner by passing a speaking order. 5. Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondents No.2 and 3/competent authority are directed to consider the representation (Annexure P-16) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondents No.2 and 3/competent authority. 6. Disposed of, accordingly.
