Biswadeep Chakraborty Ms. Ayesha Sultana, Mr. Prithiraj Das …for the petitioner This is a petition where petitioner has sought for appropriate direction for expeditious culmination of case No.C.S.76 of 2024 under Sections 138/141 of the Negotiable Instrument Act, 1881 presently pending before learned Judicial Magistrate, 8th Court, Calcutta. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the aforesaid complaint case under the N.I.Act was filed on 08.01.2025 and after one year, plea was recorded when the accused pleaded not guilty. Thereafter, since 17.02.2025, the proceeding has got stalled and the Court below has not yet recorded evidence of any of the witnesses though the statute itself prescribes time limit for early disposal of such type of proceeding. Therefore, he prayed for appropriate direction upon the Court below. Having heard learned Counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed, the 2 opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having heard learned Counsel for the petitioner and the opposite party and considering the fact that the hearing of the said proceeding has got stalled since 17.02.2025, i.e. for about one and half years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, CRR 731 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being C.S.76 of 2024, presently pending before learned Judicial Magistrate, 8th Court, Alipore and to make its best effort to conclude the trial preferably within a period of six month from the next date of hearing.
