……for the State. Learned advocate appearing for the petitioners submits petitioner nos. 1 and 3 are in custody for 7 months and petitioner no. 2 is in custody for 5 months. Charge sheet has already been submitted and charges have already been framed and date has been fixed for commencement of witnesses action. Learned advocate for the State opposes the prayer for bail, produces the seizure list before this Court as also the other statements under Section 180 of the BNSS. 2
Learned advocate for the defacto complainant also opposes the prayer for bail. It has been pointed out that the petitioners have criminal antecedents. Be that as it may, having regard to the period of detention of the present petitioners, I am of the opinion as the trial would take some time, petitioners be released on bail. Accordingly, prayer for bail of the petitioners is allowed. Accordingly, Petitioners, namely, (1) Gopal Das, (2) Nepal Das, (3) Nakul Barai shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Haldia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Purba Medinipur without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1403 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
