Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 24.07.2026 1. By the present writ petition, the petitioners are seeking following reliefs:- “ 10.1 That, this Hon'ble Court may kindly pleased to pass an order for grant of interest, which has not been paid to the petitioners inspite of the facts, that the land belonging to the petitioner have already been acquired in the year 2011 and inspite of this fact that two times representations was filed for the grant of interest, but the said representation submitted by the petitioners has not been disposed off and therefore taking into consideration of the guidelines/order passed by the Hon'ble Supreme Court of India and order passed by the Hon'ble High Court and the relevant copies of the said orders have been filed and taking into consideration of the facts those cases are identical to the case of the petitioners, the 5 Hon'ble Court may allow the writ petition filed by the petitioners and direct the respondents to disposed of said representation by directing the petitioner to a make fresh claim for the grant of payment of interest and in which all the details regarding the dispatch of the earlier representation would be mentioned. 10.2 Any other relief which this Hon'ble Court may deem and proper in the present circumstances of the case.” 2. Learned counsel for the petitioners submits that the lands belonging to the petitioners were purchased under the "आपसी सहमति से भूमिम क्रय नीति, 2016" (Land Purchase Policy, 2016 by Mutual Consent), pursuant to which an award dated 27.02.2025 was passed. He submits that although the compensation amount under the said policy has been paid to the petitioners, no amount towards interest has been awarded. It is contended that possession of the subject lands had been taken as far back as the year 2011, whereas the award came to be passed only on 27.02.2025, and therefore, the petitioners are entitled to payment of interest for the intervening period. He further submits that the petitioners have already submitted a representation dated 16.09.2025 before the Collector, District Janjgir-Champa (C.G.), as well as the other competent authorities, claiming payment of interest. However, the said representation is still pending consideration. Accordingly, it is prayed that the concerned Collector, District Janjgir-Champa (C.G.), be directed to consider and decide the petitioners' representation in accordance with law by passing an appropriate order within a stipulated period. 6 3. Learned State counsel submits that the " आपसी सहमति से भूमिम क्रय नीति, 2016" (Land Purchase Policy, 2016 by Mutual Consent) does not contain any provision for payment of interest. However, he fairly submits that since the petitioners have raised their grievance by filing a representation before the competent authority, he has no objection if the said representation is considered and decided in accordance with law. 4. Having heard learned counsel for the parties, perused the record, and taking note of the submission that possession of the subject land was allegedly taken in the year 2011, whereas the award came to be passed on 27.02.2025, this Court deems it appropriate to direct the competent authority to consider and decide the petitioners' representation claiming payment of interest, in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the petitioners' claim. The competent authority shall independently examine the representation and pass an appropriate order within a period of 45 days from the date of receipt of a copy of this order. 5.
