M/L 753 21.07.2026 Court No.24 SD
IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION
WPA 9653 of 2024
Binapani Singh Vs. The State of West Bengal & Ors.
Ms. Sudipa Biswas … for the Petitioner. Ms. Mary Datta … for the State.
1. Affidavit of service filed in Court today be kept with the records.
2. The petitioner claims to be the widow of a teacher who died-in-harness on October 10, 2022. E- PPO was issued on June 6, 2023.
3. The petitioner claims interest on account of delayed payment of the terminal dues.
4. In the case of died-in-harness, it is not possible for the authority to anticipate the death of an employee. It is only after the employee dies and the same is made known to the authority that the process for issuance of the terminal benefits starts. The same will certainly take some time.
5. In case of superannuation, the employee has enough time in his hand to submit all his papers for making his pension file ready. The same is not the case in the matter of an employee dying in harness.
6. In the instant case, the teacher died in October 2022 and the e-PPO was issued on June 6, 2023. There is hardly any delay on the part of the authority
2 in issuing the e-PPO requiring interference by the Court.
7. In view of the above, no relief can be granted to the petitioner in the instant case. The writ petition fails and is hereby dismissed.
8. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
