Although, at the time of call the petitioner is not represented, however, the Howrah Municipal Corporation is represented in Court and in terms of the order passed on 5th May, 2026 and 8th June, 2026, a report has been filed, which is taken on record. 2. From the aforesaid report, it would transpire that a spot inspection was conducted by the municipality on 25th May, 2026, wherein it was observed that both the petitioner as also the private respondents have carried out illegal construction. While the private respondents have constructed a temporary shop by encroaching the road and drain of the HMC, the petitioner has blocked the common passage at the side of the building and constructed a wholly unauthorized room cum godown attached to the main building at the ground floor which is being used commercially. 3. In the light of the disclosure made as aforesaid, I am of the view, the municipal authorities should immediately take appropriate steps in terms of the 2 WPA 13897 of 2025 provisions of Section 177 of the Howrah Municipal Corporation Act 1980 and remove the encroachment on the road, and the unauthorized construction carried out by the parties. It is expected, the proceedings in this regard shall be initiated within a period of two weeks from date and the same shall be brought to a logical conclusion within a further period of six weeks therefrom. 4. With the above observations and directions, the writ petition is disposed of.
