This appeal is directed against the order dated 06.01.2026 passed by the learned Addl. Sessions Judge-I, Dhanbad in A.B.P. No. 3174/2025, arising out of Putki P.S. Case No. 23/2024, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected. It has been submitted by the learned counsel for the appellant that the allegations are general and omnibus in nature and considering the said fact some of the co-accused persons have been granted bail by coordinate Benches of this Court in Criminal Appeal (D.B.) No. 610 of 2024 and Criminal Appeal (D.B.) No. 804 of 2024. The allegations reveal that with respect to lifting of coal dispute had arisen which led to a scuffle with the Police and thereafter both the sides started pelting stones and hurling bombs as well as firing was made resulting in one of the co-accused namely, Sonu Yadav suffering serious injuries. So far as the appellant is concerned, the allegations appear to be general and omnibus in nature and his case is similar to the co-accused persons who have been granted bail by coordinate Benches of this Court as noted above and considering the said fact, we while setting aside Neutral Citation No. ( 2026:JHHC:4753-DB ) the order dated 06.01.2026 passed by the learned Addl. Sessions Judge-I, Dhanbad in A.B.P. No. 3174/2025, arising out of Putki P.S. Case No. 23/2024, direct the appellant to surrender before the learned trial court within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Dhanbad in connection with Putki P.S. Case No. 23/2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This appeal stands allowed. (Rongon Mukhopadhyay, J.) (Pradeep Kumar Srivastava, J.)
