In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kumarganj Police Station Case No.13 of 2026 dated 16.01.2026 under Sections 103(1)/3(5)/85 of the Bharatiya Nyaya Sanhita, 2023;
Dipali Bala Sarkar & Ors. Versus The State of West Bengal
Mr. Moyukh Mukherjee Ms. Aishwarya Bazaz Ms. Sarmistha Basak. …for the petitioners.
Mr. Bankim Pal. …for the State.
Learned advocate appearing for the petitioners submits that the petitioner no.1 is the sister-in-law, petitioner no.2 is the mother-in-law and the petitioner no.3 is also the sister-in-law of the deceased. The marriage was solemnized 12 years prior to the date of the incident and it has also been apprised to this Court that the husband of the deceased was arrested and subsequently released on bail.
Learned advocate for the State opposes the prayer for anticipatory bail and submits that there was thick complicity of the present petitioners and, as such, their application should be rejected.
I have taken into account the materials appearing in the
2 case diary and I find that a case has been made out but as the charge-sheet has been submitted and the marriage was solemnized 12 years ago and the postmortem report do not reveal there were other physical injuries inflicted upon the deceased, I am inclined to grant relief as prayed for. As such, the prayer for anticipatory bail of the petitioners is allowed.
Accordingly, in the event of arrest, the petitioners, namely, Dipali Bala Sarkar, Durga Sarkar and Sonali Sarkar shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain valid for a period of six weeks.
Accordingly, CRM(A)984 of 2026 is allowed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
