ORAL ORDER
In Crl.P.No.9676/2025, the petitioners are before this Court seeking the following prayers:
"1. Quash the entire proceeding in CC no. 12263/2014 registered for the offence punishable under section 498(A), 506 of IPC and section 4 of DP Act by the respondent police and pending on the file of X ADDL, Chief Metropolitan Magistrate Mayo Hall, Bangalore City.
2. Pass such other orders as this Hon'ble court deems to fit in the circumstances of the case, in the interest of justice and Equity."
2. In W.P.No.7766/2026, the petitioners are before this Court seeking the following prayers:
"a. Issue a writ of certiorari or any other writ, order or direction thereby quashing the entire criminal proceedings against the Petitioners, pending before the X Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru in C.C. No. 54851/2018 (Annexure-A); and quash the said Chargesheet filed by the Respondent No.1 Police along with the Complaint & FIR dated December 19, 2019 (Annexure-D) and all proceedings in the pursuance of the same against the Petitioner for offences under Sections 506 and 507 read with Section 34 of the Indian Penal Code, 1860.

b. Pass such other order or directions as this Hon'ble Court may deem fit in the facts and circumstances of the case."
3. Heard Sri.Gururaja Shetty K, learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.Shirish Krishna,
learned counsel appearing for respondent No.2. and have perused the material on record. 4. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memorandum of Settlement. The Terms of Settlement contained in the Joint Memorandum of Settlement reads as follows:
“1. The parties hereby affirm that the marriage between the Petitioner No.1 herein, who is arrayed as Petitioner No.1 in the present Criminal Petition bearing CRLP No. 9676/2025 and as Petitioner No.1 in the Writ Petition bearing W.P. No. 7766/2026, and the Respondent No.2 already stands dissolved by virtue of the judgment and decree dated 11.12.2017 passed in M.C. No. 765/2016 and both parties accept the same as final and binding. 2. The Respondent No.2 hereby declares that she does not claim any maintenance, permanent alimony, compensation or any monetary benefits whatsoever from the Petitioners herein, i.e. Petitioner No.1, Petitioner No.2 and Petitioner No.3 in CRL.P No. 9676/2025 and Petitioner No.1 and

Petitioner No.2 in W.P. No. 7766/2026, either past, present or future, and the same stands fully settled. 3. It is agreed between the parties that the custody of the minor child Bhavana shall remain exclusively with the Respondent No.2 and the Petitioners herein, i.e. Petitioner No.1, Petitioner No.2 and Petitioner No.3 in CRL.P No. 9676/2025 and Petitioner No.1 and Petitioner No.2 in W.P. No. 7766/2026, shall not claim or seek enforce any custody or visitation rights, now at any point in future. 4. The Petitioners herein, i.e. Petitioner No.1, Petitioner No.2 and Petitioner No.3 in CRL.P No. 9676/2025 and Petitioner No.1 and Petitioner No.2 in W.P. No. 7766/2026, hereby unequivocally undertake that they shall not, in any manner whatsoever, interfere with the life, liberty, or peaceful living of the Respondent No.2 and the minor child. 5. The Petitioners herein, i.e. Petitioner No.1, Petitioner No.2 and Petitioner No.3 in CRL.P No. 9676/2025 and Petitioner No.1 and Petitioner No.2 in W.P. No. 7766/2026, further undertake that they shall not attempt to contact, communicate, approach, or interact with the Respondent No.2 and the minor child in any manner whatsoever, including but not limited to physical meetings, phone calls, messages, social media, or through third parties. 6.
Both parties agree that there are no claims with respect to jewellery, ornaments, stridhan, or any other movable or immovable properties, and each party shall retain whatever is in their respective possession without any further claims. 7. Both parties hereby agree that they shall not initiate or pursue or continue any civil or criminal proceedings against each other in respect of the matrimonial dispute or any cause arising therefrom, in future. 8. The Respondent No.2 has no objection to the quashing of the proceedings in C.C. No. 12263/2014 pending before the XI Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru, which is the subject matter of the Criminal Petition in CRL.P No. 9676/2025. - 7 -

9. The Respondent No.2 further has no objection to the quashing of the proceedings in C.C. No. 54851/2018 pending before the X Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru, which is the subject matter of the Writ Petition in W.P. No. 7766/2026. 10. The parties further agree that there shall be no communication or contact whatsoever between them in future in any manner either directly or indirectly, including through third parties. 11. This settlement has been entered into by the parties voluntarily, without any force, coercion, undue influence or misrepresentation. 12. In view of the above settlement, both parties humbly pray that this Hon'ble Court may be pleased to pass appropriate orders in terms of this Joint Memorandum of Settlement and dispose of the Criminal Petition in CRL.P No. 9676/2025 and the Writ Petition in W.P. No. 7766/2026 as settled, in the interest of justice and equity.”
5. The parties to the lis are present before the Court either physically or virtual mode and are identified by their respective counsels. 6.
In the light of Terms of Settlement contained in the Joint Memorandum of Settlement as quoted supra and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioners in the subject petitions. - 8 -

7. For the aforesaid reasons, the following:
ORDER [I] Criminal Petition and Writ Petition are disposed. [II] In Crl.P.No.9676/2025, proceedings in C.C.No.12263/2014 pending before the X Addl. C.M.M, Mayo Hall, Bengaluru City, stands quashed qua the petitioners. [III] In W.P.No.7766/2026, entire proceedings in Complaint, FIR dated 19.12.2019 and C.C.No.54851/2018 pending before the X Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru, stands quashed qua the petitioners.
