2 Jail, Bilaspur, was placed on record, which reveals that the sole appellant, Prabhu Kumar Manhar, expired on 20.07.2026 while in judicial custody and undergoing treatment at CIMS Hospital, Bilaspur. 3 Learned State counsel submits that during the pendency of the present appeal, the sole appellant, Prabhu Kumar Manhar, expired on
20.07.2026. 4
Learned counsel appearing for the appellant does not dispute the said fact. 5 In view of the aforesaid, and considering that the sole appellant- Prabhu Kumar Manhar has expired during the pendency of the present appeal, and no application has been filed by any of his near relatives seeking leave to continue the appeal in terms of the proviso to Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 394 of the Code of Criminal Procedure, 1973), the present appeal filed by the appellant, Prabhu Kumar Manhar, stands abated.
