Khan … for the defacto-complainant(s) Learned advocate for the petitioner submits that there was a relationship between the present petitioner and the victim and both of them are adolescent. The petitioner is in custody for eight months. Learned advocate, as such, prays that the petitioner may be released on bail on any stringent condition. Learned advocate for the State has produced the case diary. Learned advocate for the defacto-complainant appears and raises no objection. However, having regard to the statement under Section 183 of the BNSS, this court is not feeling confident regarding the stand of the defacto-complainant. 2 Having considered the same, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, steps be taken before the learned trial court for deposition of the victim within a reasonable period of time. The learned trial court would, after the evidence of the victim is over, revisit and reconsider the prayer for bail of the present petitioner. Accordingly, CRM (M) 1388 of 2026 is dismissed.
