Learned Advocate for the alleged contemnor submits that pursuant to the direction of this Court, the State Sentence Review Board, West Bengal considered the case of the petitioner Laxman Tarafdar and after considering all aspects the State Sentence Review Board in its meeting held on 11.12.2025 had come to the conclusion that on assessing the gravity of the offence i.e., gang rape committed by the life convict Laxman Tarafdar, it transpires that such type of crime has deep impact on the society and releasing convicts of such offences would send a negative message to the society. It has been found that the convict is 53 years old and is physically as well as mentally fit. Hence, his potentiality in committing similar crimes cannot be ruled out. The Board has also considered that the Hon’ble Apex Court of India in its order dated April 7, 2025 passed in WP (Crl) No. 379 of 2024 had declined to entertain the pre-mature release petition of the life convict Laxman Tarafdar. A copy of the proceedings of the State Sentence Review Board filed in court today be kept with the records. 2 In view of the seriousness of the crime and ill repute of the convict, the gravity of offence and its impact as well as potentiality to commit further crime, the Board Members are unanimously agreed not to recommend his pre-mature release at this stage. In view of the above, it appears that there is no willful violation of the order of this Court and accordingly there is no merit in this contempt application.
