(Oral) The prayer in the present petition under Section 483(3) BNSS, 2023 (Sections 439(2) Cr.P.C. is for the cancellation of bail granted to respondents No.2 and 3 vide order dated 06.04.2026 (Annexure P-3) passed by the Sessions Judge, Kapurthala in case FIR No.0063 dated 09.03.2026 under Section 304 BNS, 2023 (Section 379 IPC) registered at Police Station Subhanpur, District Kapurthala. 2. The learned counsel for the petitioner contends that, though, respondents No.2 and 3 joint investigation, they have not got recovered the two cameras in question. Therefore, the anticipatory bail granted to them be cancelled. 3. I have heard the learned counsel for the petitioner. 4. Admittedly, respondents No.2 and 3 have joined the investigation. Merely, because they have not got effected recoveries of the cameras would not be a ground for cancellation of bail as it would be a matter of Trial as to whether or not an offence has committed.
