Learned advocate appearing for the petitioner submits that the petitioner is in custody since November, 2024. Till date, no witness has been examined and the earlier order passed in CRM (M) 2105 of 2025 has not been complied with by the learned Trial Court. Learned advocate for the State submits that one witness has been examined. As has been informed by the petitioner and the State, the case is based on circumstantial evidence and there are no eye-witnesses to the incident. Having considered the entire material on record placed before this Court, I am inclined to release the petitioner on bail. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of 2 Rs.10,000/- each, one of whom must be local to the satisfaction of learned ACJM, Barrackpore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District North 24 Parganas without the prior permission of the learned Trial Court. Additionally, the petitioner shall not enter the jurisdiction of Nimta Police Station till disposal of the trial. Accordingly, CRM (M) 1428 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
