22.07.2026 Court No.35. D/L.257. Rakib (Allowed) CRM (M) 1420 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chitpur Police Station case no. 177 of 2024 dated 18.10.2024 under Sections 109(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Kiran Tiwari. ……Petitioner. Mr. Deepak Prahladka Ms. Reshmi Khatun .....for the Petitioner. Mr. Somnath Adhikary Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is similarly placed with the other accused person namely, Nitish Tiwary who have been granted bail in CRM (M) 1045 of 2025. Learned advocate appearing for the State opposes the prayer for bail but is unable to refute the parity claimed by the petitioner. Having regard to the same, I am of the opinion that the present petitioner namely, Kiran Tiwari be released on bail on same terms and conditions as was imposed to Nitish Tiwary in CRM (M) 1045 of 2025. Accordingly, the prayer for bail of the petitioner in CRM (M) 1420 of 2026 is allowed, 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
