Kausik (Allowed) CRM (A) 1866 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Lalgarh Police Station Case No. 75 of 2026 dated 05.06.2026 under sections 318(4)/351(2) of the BNS, 2023. And In the matter of : Mintu Mandal ……Petitioner. Mr. Debottam Das Mr. Tirupati Mukherjee Ms. Rajorna Mazumder ……for the Petitioner. Ms. Afreen Begum Mr. Dip Dutta ….for the Defacto Complainant. Mr. Somnath Adhikary ……for the State. Learned advocate appearing for the petitioner submits that there was a transaction between the petitioner and the complainant. Petitioner defaulted in repaying whole of the amount. As such he has been implicated in the present criminal case. Learned advocate for the defacto complainant opposes the prayer for bail. 2 Learned advocate for the State opposes the prayer for bail on the ground that petitioner promised a job for which he had taken money. Having considered the quantum of money which is the subject matter of transaction and that the defacto complainant did not make any application to any authority and no description of any job has been provided, I am of the view that custodial detention of the petitioner may not be warranted in the background of the facts of the present case. As such, prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress petitioner shall meet with the Investigating Officer by 7th August, 2026 and thereafter the Investigating Officer will fix regular dates as he deems fit and proper for the sake of investigation till the charge sheet is submitted before the jurisdictional Court. With the aforesaid observations CRM (A) 1866 of 2026 is allowed. 3 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
