1. The petitioner seeks transfer. His application seeking transfer stood rejected on repeated occasions on the ground that he is a single-subject teacher.
2. Today, it has been brought to the notice of the Court by the learned advocate representing the petitioner that the District Inspector of Schools (Secondary Education), Purba Medinipur vide communication dated 5th May, 2026 has forwarded the application of the petitioner seeking transfer to the Chairman, West Bengal Central School Service Commission for taking necessary action.
3. The prayer of the petitioner is currently pending
consideration before the School Service Commission.
4. Learned advocate for the petitioner relies on the order passed by the Court on 3rd November, 2025 in WPA
2 21342 of 2025 (Amitava Pal vs. The State of West Bengal & Ors.), wherein the Court decided the manner in which the application of single-subject teacher is to be considered by the authority.

The Court took note of the order passed by the Hon’ble Division Bench on 8th August, 2024 in MAT 1218 of 2024 with CAN 1 of 2024 (Gokul Chandra Mallick vs. The State of West Bengal & Ors.) and the order dated 31st July, 2025 in FMA 995 of 2025 with CAN 1 of 2025 in the matter of Rupak Dhua vs. The State of West Bengal & Ors.

The Court directed the authority to consider the petitioner’s application for transfer and disposed of the same in accordance with law, irrespective of the fact whether any alternative arrangement can be made or not. The resultant vacancy on the transfer of the teacher seeking transfer shall be filled up in the manner as
directed by the Hon’ble Division Bench in the matter of Rupak Dhua (supra).

As the issue has already been decided by the Court, the instant writ petition stands disposed of by directing the Commission to take a decision on the petitioner’s prayer strictly in line with the observations made hereinabove at the earliest but positively within a period of eight weeks from the date of communication of this order.

8. If the prayer of the petitioner is allowed, then all consequential steps shall be taken immediately thereafter.
9. All parties are to act on the server copy of this order duly downloaded from the official website of this court.
10. Certified copy of the server copy of the order, if applied for, shall be made available to the parties.
