2. The petitioners are apprehending their arrest in connection with Khelari P.S. Case No.66 of 2025 for the alleged offences registered under Sections 303(2), 317(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and under Rule 7/11 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the

Court of learned Judicial Magistrate 1st Class, Ranchi.

Learned counsel appearing for the petitioners submits that the petitioner No.1 is the owner and petitioner No.2 is the driver of the Tractor in question and the allegations are made of carrying 100 cft. of sand in the said tractor. He further submits that another co-accused, who is also owner-cum-driver of the another tractor, has already been granted anticipatory bail in ABA No.7394 of 2025. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.9 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there of illegally carrying the sand.

Considering that petitioner No.1 is the owner and petitioner No.2 is the driver of the tractor in question and the petitioners have got no criminal antecedent as disclosed in paragraph No.09 of the petition and another co-accused, who is also owner-cum-driver of the another tractor, has already been granted anticipatory bail in the aforesaid ABA and in that view of the matter the petitioners are
directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
