NTR RC,J W.P.No.15394 of 2026 2 DISTRICT- 520001. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue any Writ, Order or Direction more particularly one in the nature of Writ of Mandamus directing the respondents, more particularly respondent Nos.1 5 and 6, to consider the petitioner's representation dated 15.05.2026 and permit the petitioner to conduct Moharram festival from 15.06.2026 to 30.06.2026 pertaining to Hussaini Panja/Lanka Peer Panja situated at Wynchipet, Vijayawada, subject to reasonable conditions, and declare the inaction of the respondents in considering the representation dated 15.05.2026 as illegal, arbitrary, unjust and contrary to law, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Pleased to direct both rival parties have peacefully conducted the Mohurrum procession in shifts as decided by the waqf board and mutually understand and conduct the procession peacefully and independently. This order is standing in force until the Permanent Committee to Waqf board is constituted to appoint the Mutawali. Therefore, the claim and order of the Executive Officer permitting the Respondent to conduct the Mohurrum procession alone without any opportunity to the Petitioner, in violation of the orders passed by this Honble court and is biased. Therefore, this Hon'ble court may pelased to pass an order and orders to set aside the report and orders passed by the CEO if Waqf Board conseuently permit the petitioner to consider the procession of Mohurrum for the period 15-06-2026 to 30-06- 2026 and pass Counsel for the Petitioner: 1. GP FOR HOME The Court made the following: RC,J W.P.No.15394 of 2026 3 ORDER The Writ Petition is filed to consider the petitioner’s representation dated 15.05.2026 and permit him to conduct Moharram festival from 15.06.2026 to 30.06.2026 pertaining to Hussaini Panja situated at Wynchipet, Vijayawada. 2. Heard Sri Baipudi Nageswara Rao, learned counsel for the petitioner, and learned Standing Counsel for Waqf Board. 3. The learned Standing counsel for Wakf Board submitted that the representation of the petitioner dated 15.5.2026 has been considered by conducting enquiry and giving personal hearing to the petitioner as well as Shaik Jeelani and the claim made by the petitioner was rejected vide proceedings vide F.No.89/NTR/Per/2023, dated 09.06.2026, by giving cogent reasons 4. It is relevant here to note that the petitioner also filed another Writ Petition No.15440 of 2026 and in the said writ petition the proceeding dated 09.06.2026 referred to above by the learned Standing Counsel was filed. A perusal of the same shows that the representation made by the petitioner seeking permission to conduct Moharram celebrations during the period 15.06.2026 to 30.06.2026 was rejected by conducting enquiry as directed in W.P.No.13245 of 2026. In view of the above, the relief sought in this writ petition to consider the representation of the petitioner dated 15.05.2026 becomes infructuous and the writ petition deserves dismissal. 6. Accordingly, the Writ Petition is dismissed.
